Muslim Divorce due to Missing Husband

Under Muslim law, there are provisions for divorce due to missing husband. 

You can file for divorce if you do not know the whereabouts of your husband for a period of 4 years.1

Before granting the divorce, the Court will notify your husband’s close relatives and give them an opportunity to be heard. The Court will then decide whether the conditions for granting the divorce have been met.

Once the Court passes a decree, the marriage is dissolved. However, if your husband reappears within the legally specified period of 6 months, before the decree becomes final, the marriage may not be dissolved, if your husband is ready to fulfil his conjugal duties.
