Hi there,
Someon hacked my girlfriend’s account. Now she is getting harrased that they want money to get her account back and they are messaging everyone else for money. Also claiming that they will sell her account if she wont give them money.

I’m sorry to hear about your girlfriend’s situation. Hacking and extortion are serious offenses, and the law provides several protections in such cases. Here’s what you can do along with the relevant legal sections:
1. Relevant Legal Sections
Section 66C of the Information Technology (IT) Act, 2000: This section deals with identity theft. If someone uses your girlfriend’s account (which is her identity in the online world) without permission, they are committing identity theft.
Section 66D of the IT Act, 2000: This deals with cheating by personation using a computer resource. The hacker is pretending to be your girlfriend and messaging others, which is a punishable offense.
Section 384 of the Indian Penal Code (IPC): This section deals with extortion. Demanding money by threatening to sell her account or harm her online reputation falls under extortion, which is a criminal offense.
Section 67 of the IT Act: This section deals with transmitting obscene material in electronic form. If the hacker is sending inappropriate messages or content from her account, this section applies.
2. Steps You Can Take
File a Police Complaint/Cybercrime Report: Immediately file a complaint at your nearest police station or online at the Cybercrime Portal ([cybercrime.gov.in](https://cybercrime.gov.in)). Provide all details, including screenshots of the messages, hacked account activity, and the extortion demands.
Report to the Platform: Contact the platform where the account is hacked (e.g., Facebook, Instagram) and report the incident. Most platforms have a “report hacked account” option that can help recover the account and prevent the hacker from using it further.
Warn Friends/Contacts: Inform everyone that her account has been hacked and not to respond to any messages asking for money or sensitive information.
3. Additional Measures
Change Passwords and Enable Two-Factor Authentication: If she still has access to any accounts, change the passwords immediately and enable two-factor authentication (2FA) to enhance security.
Avoid Paying the Hacker: Paying ransom does not guarantee the account’s return and may lead to further demands.

First, do not delete the evidence. Document or record any communication where the person is blackmailing you. Report to your local police station and file charges under section 354(c) of IPC for sharing your images online. As the person is also sending friend requests to your friends and publishing your images, you can file the charges of defamation under section 500 of IPC and section 506 of IPC for criminal intimidation. Under the IT Act you can file charges under section 67 and 66E for transmitting obscene materials in electric form and violation of privacy respectively.
If you are a minor (under 18), and the accused is major (above 18), you can file charges against the individual under Section 13, 14 and 15 of POCSO Act for child pornography (Child pornography is defined as any nude photograph taken or transmitted to sexually exploit a child under the age of 18). You can file charges against them under section 67, 67(A), 67(B) of IT Act for publishing your material online.
If you face issues with getting an FIR registered, contact the police commissioner. You can also take help of the National commission for women, they help women deal with police for complaints such as these.
You can contact organizations such as https://stopncii.org/ or https://takeitdown.ncmec.org/ which help you take down the image if they are online on the internet.
After you have documented evidence and filed an online complaint, report the account to facebook to take it down.
