If the police are refusing to act despite a serious assault on your nephew, you can take legal steps to ensure justice. First, submit a written complaint at the police station and demand an FIR under relevant IPC sections like 307 (attempt to murder). If they refuse, escalate the matter to the DCP or Commissioner of Police under Section 154(3) of the CrPC. If there is still no action, you can file a complaint directly with the local Magistrate under Section 156(3) CrPC, who can order the police to register an FIR and investigate. Additionally, you can approach the Delhi State Human Rights Commission or the National Human Rights Commission for inaction and violation of your family’s right to safety under Article 21 of the Constitution. If you’re facing threats, request police protection in writing. As a last resort, you can move the Delhi High Court under Article 226 of the Constitution, seeking directions for FIR registration, investigation, and protection.
