If a cheque you issued has bounced, the intention of the drawer of the cheque does not matter. It is irrelevant whether or not a person intended for the cheque to bounce. Even if the bouncing of the cheque has happened without ill intent or malice it is considered illegal and a crime under the law.
However, for it to be considered a crime, the drawer should have issued the cheque to clear a legally enforceable debt, i.e., to repay money that is legally due.
For example: A cheque issued to repay a loan, pay rent, or clear payment for goods or services can be considered towards a legally enforceable debt.
