A pond is public property. No private person is allowed to build on it, fill it, or fence it. If someone has encroached on it, here’s what you should do: Before going to court, you should inform government officials in writing.
You can complain to: Gram Panchayat (in villages), Tehsildar [rural areas] , Block Development Officer (BDO), District Collector / Deputy Commissioner, Municipal Corporation (if in city area)
Submit a written complaint explaining: Where the pond is located, Who has encroached, What construction or filling has been done
Attach: Photos, Any land records if available, Your contact details Keep a copy of your complaint and ask for a receiving stamp. If authorities do not act even after your complaint, you can approach the High Court of your state and ask it to direct officials to remove the encroachment.
You do this by filing a writ petition. You will usually need: Copy of your complaint, Proof that the pond is public land (if available), Photos of encroachment
