Stopping the Abuse

Online abuse is any type of abuse that happens on the internet, whether it’s over chat, posting on message boards and forums, through social networks, playing online games or using mobile phones. 

Online abuse happens on various platforms on the internet such as social media, chat, forums, etc. When faced with online abuse, your first step should be to see what the anti-abuse policy of the platform is, and what steps the platform recommends for you to stop it. We have compiled a list of steps you can take for responding to abuse (blocking and reporting) on Facebook, Facebook Messenger, Twitter, Instagram, SnapChat, Reddit, YouTube, WhatsApp, and text messages on your phone.

If the administrators of the platform are not being responsive or you are unhappy with the results, you can also file a criminal complaint at the local police station or cyber investigation cell. It is not necessary for you to get recourse only after approaching the platform administrators. You can directly approach the police station or cyber cell to file a complaint.  When you go to the police station to file a first information report (FIR), the police have to note down the information you provide. Different provisions in law1 make online abuse and online harassment a crime. The victims of such crimes can be male or female.

Agar koi kisi ko phone par gaali deta hai Bharat mein, toh victim ke paas kai legal tareeke hote hain apne hak ke liye ladne ke liye. Yahaan kuch options hain:

1. Police mein Shikayat darj karein: Victim ko woh police station mein complaint darj karani chahiye, jahaan abusive phone call mili thi. Complaint darj ki ja sakti hai Indian Penal Code ke section 509 ke tahat, jo ‘word, gesture, or act intended to insult the modesty of a woman’ ko deal karta hai agar insult ek aurat ke liye ki gayi ho. Agar victim ek mard hai, toh complaint darj ki ja sakti hai section 506 ke tahat, jo ‘criminal intimidation’ ko deal karta hai ya fir section 504 ‘intentional insult with intent to provoke breach of peace’ ke tahat.
2. Cyber Crime Cell mein Shikayat darj karein: Agar abusive phone call mobile phone se ya internet ke zariye ki gayi hai, toh victim ko cyber crime cell mein complaint darj karani chahiye. Complaint darj ki ja sakti hai Information Technology Act ke section 66A ke tahat, jo ‘sending offensive messages through communication service’ ko deal karta hai, ya fir section 67 ke tahat, jo ‘publishing or transmitting obscene material in electronic form’ ko deal karta hai.
3. Telecom Regulatory Authority of India (TRAI) mein Shikayat darj karein: Victim TRAI mein bhi complaint darj kar sakta hai agar abusive phone call kisi telemarketer ya spam caller se ki gayi hai.

TRAI mein ek National Do Not Call Registry hai, jismein consumers apne phone numbers ko register karke unsolicited calls se bach sakte hain.
Yad rahe ki victim ko jitni bhi evidence ho sake collect karna chahiye, jaise ki phone call record karna ya date, time aur number note karna jis se call aayi thi. Legal options aur case ke circumstances ko samajhne ke liye ek lawyer se consult karna bhi advisable hai.
