Can I get a bank loan to buy a property using the same property as the collateral?

Yes. You can get a loan from the bank to purchase an immovable property by using the same property as the collateral/security. This practice is widespread when people buy residential properties in India. Home loans are generally approved on the basis that the prospective home is the collateral. Such loans fall under the definition of mortgage loans(( Section 58 of the  Transfer of Property Act, 1882.)). Commonly, when someone seeks a mortgage from a bank, they bind themselves to pay the loan, without delivering the possession of the mortgaged property, and agree that if they fail to repay the amount, the bank has the right to claim the mortgaged property and use it to settle the loan. Such mortgaged properties claimed by the creditors are often sold off in auctions as  ‘foreclosed’(( Foreclosure of property is dealt with under Section 67 of the TP Act and also the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002)) or ‘distressed’ properties under the SARFAESI Act.

Radha ji, aapka mudda samajh mein aaya, aur yeh ek gambhir samasya hai. Aapko kanooni aur turant suraksha se judi madad ki zarurat hai. Main aapko yeh dono aspects mein madad ke liye steps aur available helplines bata rahi hoon:
1. Police Mein Shikayat Darj Karna (FIR):
Aapke uncle ke padosi agar maar-peet kar rahe hain aur pareshan kar rahe hain, toh sabse pehle apne aas-pados ke kisi aur shakshi ke saath police station mein jakar FIR darj karaiye.

2. Domestic Violence Act Ka Upyog:
Agar ghar ke logon, khaas kar bachchon, par shoshan aur atyachaar ho raha hai, toh Domestic Violence Act ke tehat kanooni karwai ki jaa sakti hai. Yeh act peedit logon ki suraksha ke liye hota hai aur court ke madhyam se protection order liya ja sakta hai.
3. Bijli Ke Mamle Ka Samadhan:
Bijli ke meter aur bill ke mamle mein turant Electricity Department mein complaint darj karwaiye.
Yeh department yeh nirdharit karega ki meter kiske naam hona chahiye aur bill kaise resolve hoga.
4. Legal Aid Ke Liye Muft Madad:
Agar advocate ki fees afford karna mushkil ho, toh aap apne sheher ke Legal Aid Services ke madhyam se free kanooni madad le sakti hain.

Mahila Helpline (181): Yeh mahilaaon ki suraksha aur kanooni madad ke liye hai.

National Human Rights Commission (14433): Adhikaaron ke ullanghan par madad milti hai.

6. Zaroori Documents Taiyaar Karein:
Police aur kanooni madad ke liye aapko yeh sab documents le jane honge:
Aapka aur peedit logon ka pehchaan patra (Aadhar card ya koi ID)
Bijli bill aur meter ke sambandi kagaz
Maar-peet ke gavaah, audio-video recordings ya tasveerein (agar ho toh).
7. Court Se Protection Order:
Agar padosi lagataar dhamki de rahe hain, toh court se “protection order” lene ke liye advocate ki madad lijiye. Legal Aid Services ismein bhi aapki help karega.
Aap jaldi se jaldi police aur helplines ke saath sampark karein aur yeh steps follow karein. Agar aapko aur madad chahiye, toh main aapke saath hoon.
