1)I am a flat owner at mumbai, panvel not residing in the society in question but have a flat and parking space and my concern is that secretary is saying that if i surrender the parking space and in future any tenant is coming with car parking requirement then the society will not allow it. Is it right for the society to do this?
2) At present in my car parking space any random person is parking in my area and even though society is aware of this, secretary is saying that its not their duty to look after the parking and they are charging 900 rs per quarter to me in maintenance bill. When i raised this issue that take the parking money from the stranger who is occupying my parking without my knowledge to which they are saying that they are not responsible for anything. Please advise what legal actions i can take?
3) can i not allow any friend or relative to park at my designated parking space? As the secretary is creating nuisance that its not allowed for me to do this.
According to the Maharashtra law on apartment ownership, apartment owners have to strictly follow specific bye-laws, administrative rules and regulations that apply to a particular property. You can check your apartment bye-laws to know more about how you can use the parking space, and what is allowed. You can also check the bye-laws about the duties of your society’s Association or Board of Managers to properly maintain your parking space.
However, as the flat owner, you cannot stop contributing for common expenses used for maintaining common facilities like the parking area, even if you are not using them.
