‘Police’ and ‘Public Order’ are State subjects under the Seventh Schedule to the Constitution of India and therefore, it is the primary duty of the State Governments to prevent, detect, register and investigate crime and prosecute the criminals. 1 The State Governments perform their functions through the Police forces who have the authority to enforce laws and maintain law and order in a state. Core functions of the state police forces include surveillance and crime investigation.
Various states in our country have enacted laws that provide for special measures for maintenance of public order and security of state. For example, under the Delhi Police Act of 1978, the Administrator of Delhi may by a notification in the official gazette employ temporarily additional police in an area if that area in his/her opinion is in a disturbed or a dangerous condition.
