There is a dairy farm beside my house in a prime residential area with upto 20 cows, sheep, hen n pigeon breeding. It’s a nuisance and the waste from the animal excreta is breeding ground for all kids of diseases during this COVID time. How can they conduct commercial activities in residential area n cause disturbance to the other residents. Please suggest a way to get rid of this nuisance.
To know whether commercial activities are permitted in your residential area, you will have to refer to your municipality-specific rules.
If the dairy farm is causing a public nuisance, you can file a criminal complaint against the person running the farm. Causing a public nuisance is a criminal offence under Section 268 of the Indian Penal Code.
The law punishes any person whose action causes any common injury, danger or annoyance to the public or to the people who live in the neighbourhood of the nuisance. A person is also punishable if he/she negligently does any act which he/she believes is likely to spread the infection of a dangerous disease. The punishment is imprisonment for up to six months and/or a fine.1
