Yes, this would be an offence and the man would be punished under Section 316 of the Indian Penal Code. If the foetus had quickened, i.e. when the pregnant woman started feeling the movements of the foetus, then the punishment for the same crime is harsher, which is jail time upto 10 years and fine.
