Filing A Noise Complaint

If any noise is being made which causes you annoyance, discomfort or any injury, then you can file a complaint with the authorities given below. You can also complain if you know that the noise level has exceeded the noise standards by 10 dB(A) in any area or there is noise pollution that happens at night between 10:00 pm and 6:00 am.

Police

You can complain to the nearest police station, call 100 or file an online complaint with your State’s police complaint portal if you want to prevent noise pollution. The officer in charge of the police station, police commissioner or any officer (not below the rank of Deputy Superintendent of Police) can take action by:

  • Seizing equipment, 
  • Stopping the use of a microphone or loudspeaker, etc.
  • Going to the Pollution Control Board and getting a written order prohibiting the noise.  

Central and State Pollution Control Board

The Central Pollution Control Board (CPCB) provides technical services to the Ministry of Environment and Forests for implementation of the provisions of the Environment (Protection) Act, 1986. Its main functions are to promote cleanliness of water in streams, wells, etc. and prevent water pollution. The Board also has the duty to improve the quality of air by preventing air and noise pollution. The Head Office of the CPCB is in New Delhi and they also have several regional offices across states.

Even though the offices of the CPCB are only there in a few states, every state also has an office known as the State Pollution Control Board (SPCB). You can also approach the SPCB offices to file a complaint. These authorities have the power to issue a written order for preventing, prohibiting, controlling or regulating:

  • Any vocal or instrumental music
  • Sounds caused by  playing, beating, clashing, blowing 
  • Instruments including loudspeakers, public address systems, horn, construction equipment, appliance or apparatus which is capable of producing or reproducing sound
  • Sounds caused by bursting of sound emitting fire crackers
  • Sounds caused from a business operation, or trade, for example, business of manufacture of utensils, etc.

The authorities may give an opportunity to the person who made the noise to be heard and then may modify or alter the order.  

Courts

District Magistrate

You can approach the nearest District Magistrate (Court) with the help of a lawyer to complain about noise pollution. The Court has the power to temporarily stop or remove the nuisance caused by noise pollution. The Court may pass the following orders after hearing out the person who caused the noise pollution:

  • Temporary order or injunction to stop the noise
  • Order to remove the noise or regulate it
  • Permanent order to remove the noise pollutant and stop the noise 

National Green Tribunal

The National Green Tribunal (NGT) is a specialised judicial body where you can go to file environmental cases including noise pollution cases. The NGT was set up to: 

  • Provide effective and expeditious remedies for  environmental protection,
  • Conservation of forests and other natural resources
  • Enforcement of any legal right relating to the environment. 

The NGT’s orders are binding and it has power to grant relief in the form of compensation to affected persons.

Locations of the Tribunal

The NGT has a presence in five zones – North, Central, East, South and West. The Principal Bench is situated in the North Zone, headquartered in Delhi. The Central zone bench is situated in Bhopal, East zone bench in Kolkata, South zone bench in Chennai and West zone bench in Pune.

Filing a Complaint with the NGT

Any person seeking relief and compensation for environmental damage or pollution involving subjects like air pollution, environment pollution, water pollution, etc. can  approach the NGT. The decisions of the NGT are binding and you can appeal within 90 days to the Supreme Court if you are unhappy with its decision. 

You can engage a lawyer if you want to approach the Court to file a case or file an appeal from a judgment of a lower Court.

If construction of a building or other type of structure is being proposed near the home or property of another person, under limited circumstances the person may have the right to legally stop, “enjoin” in legal terminology, that construction under the theory of nuisance.
One remedy for nuisance is to file a lawsuit seeking an injunction to stop the nuisance. If a court finds that a nuisance exists, it can issue an injunction that orders the party responsible for the nuisance to stop the activity that creates it.
You may also approach the Central or State Board under Sections 16 and 17 of the Air (Prevention and Control of Pollution) Act, 1981 which includes noise as an air pollutant. The Rules made under this Act specifically deal with noise pollution.

The adjoining building to my house has a saw mill (residential area) that’s working through out the day ,through out the week.The sound is consistent and irritating and over the years my father has developed high blood pressure with no other ailments or stress. A police officer I know is advising that unless there is an arguement of violent nature they cannot intervene to their fullest means. How should I proceed ?

I’m facing a lot of issues including my parents who are above 60yrs. My neighbors put on there loudspeakers everyday in th morning at 5AM. It really disturbs our sleeping pattern. This can lead of severe health issues. Local police is also not taking any action. We even registered a written complaint but no action taken yet.

My name is syed jaffer leaving bangalore, karnataka state actually near my home there was a tinkering shop they were hardly getting trouble to all people they were repairing some AUTO repairs making hell of noise pollution here, can’t able to stay at home 🏠 during facing health lots of people’s, students can’t able to study properly and can’t able to work office work during this noise it’s getting too much headache , we already did a police complain across 100 times but no use police will come they used to stop 1 or 2 days that’s it what happened the next again they will start same thing if we go and scold also they used to fight for us back itself they are not stopping this please it’s a humble request to you please do something that’s want I to say from me.

Causing Public Nuisance
Creating noise is considered to be a public nuisance when you cause any injury, danger or annoyance to the public. For example, if your neighbour plays a sound system at midnight very loudly, then this is a public nuisance.
The punishment for such nuisance is a fine up to Rs. 200. If you continue to make noise even after the Court directs you to stop the noise, the punishment is jail time up to 6 months along with a fine.

Causing Environmental Pollution
Since noise pollution causes significant harm to the environment and surroundings, it is taken seriously under the law. For example, if the construction noise of a building is making it hard for you to live, then this is a form of noise pollution.
The punishment for this offence is jail time up to five years and/or a fine up to Rs. 1 Lakh.
If the noise pollution continues, then you may be punished with an additional fine of Rs. 5000 for every day the pollution happens. If the noise continues for more than a year despite orders to stop it, then you may be punished with jail time up to 7 years.
You have a right to complaint noise pollution and the authorities will take action against the responsible persons.

Agar aapka noise complaint karne par ticket close aa raha hai toh aap 2 alag uppaye bhi kar sakte hai:
• Police: Yadi aap noise pradooshan ko rokana chaahate hain to aap nearby police station mein complaint kar sakate hain, 100 par call kar sakte hain ya apne state police ke online portal par complaint file kar sakte hai. Complaint file karne ke baad, Police investigation kar sakti hai aur aapko 3 tarah sei madad kar sakti hai jaise: instrument ko disturbance create kar rahi hai usei jabt karana, microphone and loudspeaker ka use band karwana and pollution board ke paas jaake written notice parapt kar sakti hai taaki notice dekar noise pollution band karwa paaye.
• District Magistrate : Aap ek vakeel ki madad se najdeeki District Magistrate (Court) ke paas jaa sakte hain noise pollution ke khilaf shikayat darj karne ke liye. Adalat ko noise pollution dvara hone waali takleef ko samayik roop se rokne ya hatane ki shakti hai. Adalat shor pradushan ka karan banane waale vyakti ko sunne ke baad nimn prakar ke aadesh jaari kar sakti hai: Shor ko rokne ke liye temporary ya injunction order de sakti hai, Shor ko hatane ya uska niyantran karne ka adesh de sakti hai aur permanent order de sakti hai uss noise pollution ke karan ko hatane ke liye taaki noise pollution permanently ruk jaaye.

Commuting on Desh bandhu gupta road in karol bagh, there is so much extensive honking all around. Not just on traffic signals but on the whole stretch. Especially the e-rikshaws and the commercial autos honk continuously. It’s just very annoying and there doesn’t seem to be any traffic police to monitor the traffic on the road or anywhere in karol bagh.

Hi. I live in Pune and our society is having so much noisy work continuous drilling since last 1 month for seepage and waterproofing work. This work is happening from builder side and they are working randomly without any plan and timeline in place. The society handover is still not done completely and most of us are struggling a lot due to this continuous noisy drilling. Can you please suggest that what are our rights here and how can we live comfortably? I bought ready to move flat in July 2019 but still things are not smooth and it seems, residents become helpless in front of builder. It is advised that you file a suit for a permanent injunction against your neighbour. Meet a lawyer and prepare your case accordingly. The court will issue directions even to state authorities to take necessary actions to stop the nuisance.
Recently, Two developers and three workers have been penalised by police in a span of four days for violating guidelines on noise pollution. The action has been taken under the Bombay Police Act against ongoing construction work at Chembur and Andheri following complaints from residents. It was ordered that the construction activity would have to be limited to the prescribed timing of 6 am- 10 pm and decibel levels should not be higher than 65dB in residential areas. Further, the developers were instructed to developers to place sound barriers at construction sites. If not complied with, strict action as per the Indian Penal Court will be taken.

General Diary is a record that is maintained chronologically on day-to-day basis, the General Diary entry reference is also mentioned simultaneously in the FIR book, while FIR number is mentioned in the General Diary entry since both of these are prepared simultaneously. No police officer can refuse to file an FIR if the complaint falls within the jurisdiction of the said police station.

मेरे गाँव के मंदिर में प्रतिदिन 4 बजे सुबह से लेकर 7 बजे सुबह तक लाउडस्पीकर पर गीत बजाया जाता है जिससे हमारे मस्तिष्क पर बहुत प्रभाव पड़ता है और ऐसे ही दिन भर में कई बार कभी भी 3 से 4 घण्टे स्पीकर पर गाना चला दिया जाता है ।
इसके अलावा मन्दिर में ही प्रतिदिन माइक में तेज आवाज पर लम्बा (3-4 घण्टे का)कार्यक्रम होता है जिससे पढ़ाई और अन्य कार्य करने बहुत परेशानी होती है।हमे क्या करना चाहिए?

नियम के अनुसार अगर आपका क्षेत्र एक आवासीय (रेजिडेंशियल) क्षेत्र है तो दिन के समय (सुबह 6 बजे से रात 10 बजे तक) 55 डेसिबल और रात के समय (रात 10 बजे से सुबह 6 बजे तक) 45 डेसिबल से ज़्यादा शोर करने की किसी को अनुमति नहीं ह। आपके क्षेत्र में हो रहे शोर के लिए आप नीचे दिए किसी भी तरीके से शिकायत दर्ज कर सकते हैं-

पुलिस
यदि आप ध्वनि प्रदूषण को रोकना चाहते हैं तो आप नजदीकी पुलिस स्टेशन में शिकायत कर सकते हैं, 100 नंबर पर कॉल कर सकते हैं या अपने राज्य के पुलिस शिकायत पोर्टल पर ऑनलाइन शिकायत दर्ज करा सकते हैं। पुलिस थाने के प्रभारी अधिकारी, पुलिस आयुक्त या कोई भी अधिकारी (जो पुलिस उपाधीक्षक के पद से नीचे का न हो) उपकरण जब्त कर सकते हैं या माइक्रोफोन/ लाउडस्पीकर आदि का प्रयोग बंद कर सकते हैं एवं प्रदूषण नियंत्रण बोर्ड में जाकर शोर-शराबे पर रोक लगाने का लिखित आदेश प्राप्त कर सकते हैं।

राज्य प्रदूषण नियंत्रण बोर्ड
आप शिकायत दर्ज करने के लिए राज्य प्रदूषण नियंत्रण बोर्ड कार्यालयों से भी संपर्क कर सकते हैं। इन अधिकारियों के पास आपके क्षेत्र में ध्वनि प्रदूषण को रोकने, प्रतिबंधित करने या नियंत्रित करने के लिए एक लिखित आदेश जारी करने की शक्ति ह।

डिस्ट्रिक्‍ट मज‍िस्‍ट्रेट
ध्वनि प्रदूषण के बारे में शिकायत करने के लिए आप वकील की मदद से निकटतम डिस्ट्रिक्‍ट मज‍िस्‍ट्रेट (कोर्ट) से संपर्क कर सकते हैं। न्यायालय के पास शोर को रोकने, शोर को हटाने या इसे विनियमित करने के लिए अस्थायी आदेश या स्थायी आदेश पारित करने की शक्ति है।

hello, this is sabari from valasiramani village 621214. in my village near temple there is loud speaker which causing noise pollution. its been played for no reason (not a festival). students near the temple are unable to prepare for an exam. the songs being played from morning 5.30 am to mid night 11 or 12 o clock. sometimes the volume is so high it cause a ear discomfort. please help us with this issue. also they are playing songs frequently without any reason.

We are facing a huge sound pollution of dj played in our area (near thakurani temple, suruchi bazar road,joda keonjhar,odisha ). Due to loud sound headaches and migraine has aroused in our family. A loud speaker cannot be used without written permission from the authority designated by the government and cannot be used at night time (between 10pm and 6am)
The government can permit the use of loud speakers between 10pm and 12am midnight during any religious or festive occasion only for a limited duration of up to 15 days in each calendar year. It also mandates that the state as a whole would be considered as a unit and the respective state government has to specify the 15 days in advance when this exemption would apply.

To lodge a formal complaint to:
1. The civil society and/or the local council,
2. A police complaint
3. Filing a PIL
Instead of filing individual petitions, details from various cities and towns can be clubbed before filing in the Court. However, before doing so, it is essential to submit a representation to the Police and District Collector.

Citizens should take acknowledgement of receipt of the complaint from the Police station and the District Collector’s office and keep it with them.

in my home and whenever function is occurring, we are facing huge sound pollution of DJ played in our area. Due to this Heavy sound We are facing many problems continuously because of loud noise it’s affecting / disturbing our daily routine work and can not even stay in home due to this I can not concentrate on my work and my parents has health issue .
First a fall, we requested them like please reduce volume politely and we are not even demand to stop the songs .But they didn’t listen our words and insulting us like we can not reduce volume and stop the songs. He said , where ever you can go and complaints no issue, I know how to handle it and shouting us on the road. It’s really hurting and going to depression mode. I need a proper solution for this.

A person may, if the noise level exceeds the ambient noise standards by 10dB(A) or more given in the corresponding columns against any area/zone or, if there is a violation of any provision of these rules restrictions imposed during night time, make a complaint to the authority.

The authority shall act on the complaint and take action against the violator in the accordance with the provisions of these rules and any other law in force.

If the authority is satisfied from the report of an officer in-charge of a police station or other information received by him including from the complainant that it is necessary to do so in order to prevent annoyance, disturbance, discomfort or injury or risk, annoyance, disturbance, discomfort or injury to the public or to any person who dwell or occupy property on the vicinity, he may, by a written order issue such directions as he may consider necessary to any person for preventing, prohibiting, controlling or regulating.

a. The incidence or continuance in or upon any premises of

i. Any vocals or instrumental music

ii. Sounds caused by playing, beating, clashing, blowing or use in any manner whatsoever of any instrument including loudspeakers, public-address systems, horns, construction equipment, appliance or apparatus or contrivance which is capable of producing or re-producing sound or

iii. Sound caused by bursting of sound emitting fire rackers, or

b. The carrying on in or upon, any premises of any trade, avocation or operation or process resulting in or attended with noise

The authority empowered under sub-rule (1) may, either on its own motion, or on the application of any person aggrieved by an order made under sub-rule (1), either rescind, modify or alter any such order:

Provided by that before any such application is disposed of, the said authority shall afford to the applicant and to the original complainant, as the case may be, an opportunity of appearing before it either in person or by a person representing him and showing cause against the order and shall, if it rejects any such application either wholly or in part, record its reasons for such rejection.

2. if police does not take any action you can file complaint before magistrate and seek orders under section 133 of IPC for removal of the nuisance

I have been suffering due to a two wheeler workshop ( in residential area) which functions from morning 7 to night 10:30. Sometimes, till 2 AM they used to dismantle the two wheelers. They use many huge compressors which release huge noise, and doing water service without any drainage connection. The water is allowed in the road side only. They burn the waste plastic covers also in the public at least 3 times a day.
We have been writing to police station, local municipality and TNPCB for the past 14 years. But, every one visit and agree that there is a violation by the workshop and the the workshop is closed for half day. From next day morning, same issue.
Due to these complaints, we were threatened and we filed separate complaint for this in police dept.

However, still we struggle due to this and my aged parents are not at all able to sleep. My mother is also a heart patient and needs rest in day time. But, unable to.
What can I do on this further?

There are some general remedies available in for removing nuisance that are :-

*Abetment;* it means removable of nuisance by the person affected, but the removable must be peaceful and life should not be endangered.

*Injection;* it is based on the nature of the nuisance and if the nuisance is such that it is impeding and should be stopped. Then injection is necessary.

*Damages;* if plaintiff succeeds in proving that the nuisance caused damages to his property or health, and then the Court may order for payment of compensation for the damages.

In this case you can make a complaint to Ministry of Environment affairs of Tamilnadu and Ministry of Environment, Govt. of India to take action against the Autopart Shop owner.

Also, In this case you can a file complaint before TNPCB again and have receiving on the duplicate copy. Even after this if TNPCB can not action then file a Writ petition before the Hon’ble High Court of Tamilnadu to order TNPCB to take action against the autoparts shop.

Through this letter of mine, I wish to draw your attention to the problem of noise pollution being caused by unrestricted use of loudspeakers in the area. Though everyone is aware that prohibitory ban use of loudspeakers is in force, they are used unscrupulously.

A loud music of bhakti song were created in Nirsa parwati temple on daily basis which harms locality students and me.

Incident address is Nirsa police station temple’s pin code -828205 nirsa ,dist-Dhanbad,post -nirsa,state -Jharkhand

As a result the residents of the area do not get peaceful sleep and students cannot concentrate on their studies. It creates problems for the sick also as they get disturbed by the loud noise which were created by Nirsa Police station Parwati Temple opposite of Nirsa post office.

I have complain before many times to the temple management, but the requests have fallen flat on deaf ears.

I, therefore request you to strictly implement the orders of restricted use of loud speakers in the temple . The residents of this locality will be grateful to you for this act of yours.

If you have spoken to your neighbour about the same and the noise continues to bother you and if you see no visible change in their behaviour, you must try to notify the owner of their flat/home so that corrective measures can be taken. You may also approach the Central or State Board under Sections 16 and 17 of the Air (Prevention and Control of Pollution) Act, 1981 which includes noise as an air pollutant. The Rules made under this Act specifically deal with noise pollution.

Rule 8(1) of the act states that if an authority is satisfied by the report of officer in charge about the information given by the complainant which is necessary to prevent the disturbance, annoyance caused to the public or any person in the vicinity , he may by a written order issue directions for preventing, prohibiting:

The continuance of:
any vocal instrument or music,
sounds caused by playing, beating, blowing any instrument including loudspeakers, public address systems, horns, etc.
sound caused by bursting crackers.
carrying on any trade or process resulting in noise.

Process you can adopt:
Call the Police helpline at 112 and tell them the problem if
a. the noise is between 10 P.M. and 6 A.M. and is above the legal decibel limit, or
b. is a persistent noise in the day time due to any unlawful activity such running shows, parades and rallies without due permission or any functions without legal permission.
The noise ceases after the beat constable or the IO asks them to stop in courtesy.
If the noise doesn’t stop, go to their Police Station of appropriate jurisdiction and lodge an FIR asap.
The Police will not investigate and the state will prosecute.

Section 268 of the Code states that a person will be guilty of public nuisance if he has caused annoyance to the public (in this case, people who dwell in the area). It is no defence that the injury was caused to obtain any advantage.

Further, if there is noise after 10 p.m, you may contact the local police and they will give your neighbour a warning. If this does not work you may file a case under Section 290 of the IPC and they will have to pay a fine of Rs. 200.

There is a cooperate building beside our apartment. The night shift staff have been bursting crackers from around 1AM to 6AM with breaks in between. They did this during Diwali and after diwali and i had to go tell them that i would call the police and they stopped. Suddenly out of no where today(after being silent for a few days) post 3:30AM they bursted 2 hydrogen bombs. I couldn’t record as the duration they keep is for limited time. If any noise is being made which causes you annoyance, discomfort or any injury, then you can file a complaint with the authorities given below. You can also complain if you know that the noise level has exceeded the noise standards by 10 dB(A) in any area or there is noise pollution that happens at night between 10:00 pm and 6:00 am.

Here is what you can do to address such situations-
1. The first step you should take is to call the police. Give them coherent details about the problem. Tell them how the noise is causing annoyance, the time since it has been going on, and the address. You may do so anonymously.
2. A complaint can also be filed with the Pollution Control Board, as noise pollution has been classified as an air pollutant.

Here are some steps you can take further –
1) The Central Pollution Control Board (CPCB) provides technical services to the Ministry of Environment and Forests for implementation of the provisions of the Environment (Protection) Act, 1986. Its main functions are to promote cleanliness of water in streams, wells, etc. and prevent water pollution. The Board also has the duty to improve the quality of air by preventing air and noise pollution. The Head Office of the CPCB is in New Delhi and they also have several regional offices across states. Even though the offices of the CPCB are only there in a few states, every state also has an office known as the State Pollution Control Board (SPCB). You can also approach the SPCB offices to file a complaint. These authorities have the power to issue a written order for preventing, prohibiting, controlling or regulating:
a) Any vocal or instrumental music
b) Sounds caused by playing, beating, clashing, blowing
c) Instruments including loudspeakers, public address systems, horn, construction equipment, appliance or apparatus which is capable of producing or reproducing sound
d) Sounds caused by bursting of sound emitting fire crackers
e) Sounds caused from a business operation, or trade, for example, business of manufacture of utensils, etc.
f) The authorities may give an opportunity to the person who made the noise to be heard and then may modify or alter the order.
2) Noise pollution is a public nuisance and is a civil wrong. Section 91 of the Civil Procedure Code (CPC) says that you can initiate a civil suit for the offense of Public nuisance with the help of a civil lawyer. Under this section, a member of the community who is being inconvenienced can initiate a suit for appropriate relief, eg.- an injunction. This means that one can have their rights declared and as a consequence, be granted an injunction. The injunction would order the person at whom it is directed to do or stop doing a certain thing, in this case, the nuisance.

4) As the above section also says that you can seek simultaneous relief under the criminal jurisdiction, through Section 133 of the Code of Criminal Procedure (CrPC). Under this section, the magistrate is allowed to stop the situation that is causing the nuisance. This means that the Magistrate can order the nuisance-causing activity to cease.
5) You can also file a Public Interest Litigation if the situation requires it. Article 32 of the Indian Constitution speaks of this tool which directly connects the public with the judiciary. Through a PIL, a member of the public is given the right to file a suit. This is judicial activism. The member of the public filing the PIL may be an individual, an institution, or a nongovernmental organization. A PIL can be filed in any High Court or directly in the Supreme Court. Under Section 133 of CrPC, a PIL may be filed in front of a magistrate as well.
6) The National Green Tribunal (NGT) is a specialised judicial body where you can go to file environmental cases including noise pollution cases. The NGT was set up to:
a) Provide effective and expeditious remedies for environmental protection,
b) Conservation of forests and other natural resources
c) Enforcement of any legal right relating to the environment.
The NGT’s orders are binding and it has power to grant relief in the form of compensation to affected persons.

We have two schools adjacent to each other infront of my house and in residential area… One is government supported one and other one is private… These schools use loud speakers, band and all activity and make lot of noise from morning 7.30 till evening 5 pm.. Even upon requesting to management they are doing it repeatedly…. Every month they organise some events and make lot of noise… Informed local police about this issue… They just come and tell it’s educational one and take money from the school authorities and go. There is a gurudwara in my neighborhood and for the past 10 years we’ve been subject to constant loud kirtan from there. Our house is in direct path of it and it starts every morning around 7, sometimes afternoons and everyday evenings. It’s a whole different matter during Gurupurabs where it goes on all day.
I’ve written to SGPC about it and they have already issued guidelines that gurudwara noise shouldn’t go beyond its perimeter but these people still haven’t stopped.
Even the police is doing nothing bcz apparently someone knows someone in there and they turn a deaf ear.

I am a student preparing for neet examination. My house is next to a temple. They start making loud ugly noises and call it singing. They use loud speakers and stupid sound making things and call in musical instruments. I am losing my sanity. I wake up with an irritable mood every morning.They start this early in the morning around 6. When I try to study early in the morning I can’t because of their noise and when I try to study in the night and sleep mornings I still can’t. I measured the noise they make with an online app and it exceeds 90db. There should be something I can do against them to make them shut up. We even went to him and requested to shift his cutter somewhere else but the owner told us that he won’t stop and he has NOC to operate the shop even though that is a residential area.

I live in an area which has both residential properties and factories. There is a factory that is next to my house. Initially there was no problem. However now the factory operates throughout the night. The machines are so loud and the noise from their operation is all over my house. I have 2 senior citizens and my mother and father who find it really hard to sleep due to the constant noise at night. My mother is a patient of hypertension who already has sleeping problems.
